About the seminar

A vital new seminar for all those advising on property in Scotland - or on Scottish taxes. 


Change is nearly afoot to the additional dwelling supplement to land and buildings transaction tax. Before these sessions take place, we have now seen at draft legislation which may solve some of the perceived difficulties and unfairness caused by ADS. But that is unlikely to be in is final form and many problems will remain. Some new ones – certainly new uncertainties – may be created. The new rules will not be retrospective and may not be in force for some months. They are in any event unlikely to cure everything thought to be unfair with ADS.


In the meantime, in what was something of a shock, the rate of ADS rose by one half, from 4% to 6%, from 16 December 2022. 


Furthermore, there has recently been a broad array of decided cases on ADS, mostly confirming the wide scope of, and limitations to reliefs affecting, this very demanding tax.


This seminar will address all of these matters, with some suggestions for planning and consideration of the case law. There is, unfortunately, plenty in ADS, so this seminar will not stray into wider LBTT matters more than absolutely necessary.


Having completed his normal stints at other seminars and standing in for Santa Claus and the Easter Bunny, the seminar will be delivered by Alan Barr, Head of Personal Tax Planning at Brodies and Honorary Fellow at the University of Edinburgh. As no-one, including Alan Barr, wishes to listen to this stuff for 2 hours, there will be some scope for questions and discussion in each seminar.


But as a bonus, there will also be a specific Q & A Zoom session following the last of the scheduled seminars, developing from questions posed at the seminars and otherwise and at which representatives from Revenue Scotland will also participate. This will take place on Thursday 27 April from 12.30-1.30pm.
