Getting cross across borders: Case study workshop

About the workshop 

  

Do you have clients north and south of the border starting to line up succession plans? Perhaps you’re a litigator fascinated by contentious private client matters? Or maybe contentious elements have arisen with your private clients? 


Join us online as we venture into the world of private wealth disputes and examine a case study focusing on complex modern families on each side of the Scottish and English border. We will explore how such families are impacted by the different succession laws on either side of the border, how each regime deals with cohabiting couples, court remedies where agreement cannot be reached, solicitor's duties, and conflicts of interest. 


Our workshop format invites active participation through the use of breakout rooms on Zoom but rest assured, other Brodies team members will be present to help facilitate discussion! Building on our previous successful workshops, we continue crafting a practical toolkit to set you and your clients up for success.

Learning objectives: By attending this workshop you will:-


  1. Have a clear understanding of the law applicable to cohabiting couples on death under the Scottish and English regimes.
  2. Understand what steps cohabiting couples might take during their lifetime on either side of the border to better protect their interests and those of their wider family (such as children from previous relationships).
  3. Understand what remedies might be available to the surviving cohabitee and wider family members under Scottish and English law, in both testate and intestate scenarios.
  4. Be confident advising clients on their options where litigation may be necessary following the death of a cohabiting partner. 
  5. Be clear about your professional obligations in relation to advising cohabiting couples.
